Real? The tape exists, though there doesn’t seem to be any actual sex on it.

Gawker acquired the Eric Dane – Rebecca Gayheart – Kari Ann Peniche sex tape on Monday, August 17, 2009, and posted a tame (no genitals) excerpt, along with some detailed explanation of who these three people are. The full tape apparently runs twelve minutes, while the Gawker excerpt runs four minutes.

TMZ didn’t actually post the sex tape, but they received a cease-and-desist notice anyway. Dane and Gayheart’s lawyer vows to sue anyone who distributes what he calls “a private, confidential tape.” The lawyer gets off the wittiest line of this affair so far: “From what I’ve seen it’s a naked tape, not a sex tape. At most it’s 3 people maybe wanting to have sex.”
